1. Service Description

HammerSpot is a free online service that helps homeowners compare quotes from local home improvement contractors. We collect information about your project and match you with contractors through our lead generation partner, Modernize (a subsidiary of QuinStreet, Inc.).

HammerSpot is not a contractor. We do not perform any home improvement work, provide estimates ourselves, or employ any of the contractors who may contact you. We serve solely as an intermediary connecting homeowners with third-party contractors.

2. Eligibility

To use the Site and submit a quote request, you must:

• Be at least eighteen (18) years of age
• Be a resident of the United States
• Be the homeowner of the property for which you are requesting quotes, or be authorized by the homeowner to request quotes on their behalf
• Provide accurate and complete information

3. User Obligations

By using the Site, you agree to:

• Provide truthful, accurate, and complete information in all form submissions
• Not submit false, misleading, or fraudulent information
• Not use the Site for any unlawful purpose or in violation of any applicable laws
• Not interfere with or disrupt the operation of the Site
• Not attempt to gain unauthorized access to any part of the Site or its systems
• Not use automated tools, bots, or scripts to access the Site without our prior written consent

4. TCPA Consent and Communications

By submitting a quote request through the Site, you provide your express written consent under the Telephone Consumer Protection Act (TCPA) and applicable state laws to receive:

• Telephone calls, including calls made using an automatic telephone dialing system or prerecorded voice messages
• Text messages (SMS or MMS)
• Emails regarding your project

These communications may come from HammerSpot, Modernize, and up to four (4) home improvement contractors matched to your project, at the phone number and email address you provide.

Your consent is not a condition of purchasing any goods or services. You may revoke your consent at any time by replying STOP to any text message, by requesting removal during any phone call, or by contacting us directly. Standard message and data rates may apply.

5. No Guarantee

We do not guarantee:

• That contractors will be available in your area for your specific project
• The quality, reliability, or qualifications of any contractor
• The accuracy of any quotes, estimates, or pricing provided by contractors
• That you will receive any specific number of quotes or contractor responses
• The outcome of any work performed by a contractor

Any contract or agreement for home improvement services is solely between you and the contractor. HammerSpot is not a party to any such agreement and bears no responsibility for the performance, quality, or outcome of any work.

6. Intellectual Property

All content on the Site, including text, graphics, logos, design, and software, is the property of HammerSpot LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written permission.

The HammerSpot name and logo are trademarks of HammerSpot LLC. You may not use them without our prior written consent.

7. Disclaimers

THE SITE AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT ENDORSE, WARRANT, OR GUARANTEE ANY CONTRACTOR OR THEIR SERVICES.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HammerSpot LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY SERVICES PROVIDED BY THIRD-PARTY CONTRACTORS.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

9. Indemnification

You agree to indemnify, defend, and hold harmless HammerSpot LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We reserve the right to suspend or terminate your access to the Site at any time, for any reason, without notice or liability. We may also remove or refuse to process any quote request that we believe violates these Terms or is otherwise fraudulent or harmful.

Upon termination, all provisions of these Terms that by their nature should survive will survive, including intellectual property provisions, disclaimers, limitations of liability, and indemnification obligations.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of laws principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of such courts.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
